PHILADELPHIA – A Wallingford woman is seeking damages following an incident in which she claims unfair debt collection practices.

Deborah A. Kerr filed a complaint on June 22 in the U.S. District Court for the Eastern District of Pennsylvania against the Sobel Law Firm, alleging violation of the Fair Debt Collection Practices Act, the Pennsylvania Fair Credit Extension Uniformity Act and the Pennsylvania Consumer Protection Law.

According to the claim, the defendant contacted Kerr on March 4, 2015, to collect an alleged due debt. However, the suit states, the defendant failed to notify the plaintiff of the 30-day validation notice, in which time the plaintiff was legally allowed to dispute and request validation of the debt. Through its failure to notify the plaintiff of such allowances, the defendant took part in deceptive practices, the suit states.

Kerr seeks attorneys' fees, as well as court costs and actual, statutory and treble damages. She is demanding a jury and is represented by Brent F. Vullings of Vullings Law Group LLC in Collegeville.
