PITTSBURGH — An iron labor union is suing a Pittsburgh ironwork contractor, alleging the company failed to promptly pay union fees.

Greg Christy and William C. Ligetti, on behalf of the trustees of the Iron Workers Welfare Plan of Western Pennsylvania, Iron Workers of Western Pennsylvania pension plan, and the Iron Workers of Western Pennsylvania profit sharing plan; and as agents for The Ironworker Employers Association of Western Pennsylvania Inc., The International Association of Bridge, Structural and Ornamental Iron Workers, Local Union No. 3, AFL-CIO, filed a lawsuit Feb. 19 in U.S. District Court for the Western District of Pennsylvania against Matcon Diamond Inc., alleging violations for the Employee Retirement Income Security Act of 1974 (ERISA) and the Labor-Management Relations Act of 1947 (LMRA).

According to the complaint, Matcon Diamond entered into a labor agreement with the union, pursuant to which, the defendant agreed to make monthly payments to plans for pension, medical, profit sharing, dues, and other provisions. The agreement states the defendant is required to pay interest and liquidated damages if it does not make payments, the suit says.

The plaintiffs allege the defendant failed to timely pay an audit deficiency for 2014 and 2015 totaling $5,920.08. They say interest will accrue after Feb. 15, 2016, at the rate of $1.97 per day.

Christy and Ligetti seek immediate payment of past due money, remittance reports covering the defendant’s business operations, and audit of the defendant’s accounts, liquidated damages, attorney fees and a guarantee of payment. They are represented by attorneys Jeffrey J. Leech and Neil J. Gregorio of Tucker Arensberg PC in Pittsburgh.
