Dentist accuses former practice of defamation, misrepresentation

PITTSBURGH – A Pittsburgh dentist is suing a dental practice, alleging it is refusing to remove her name from its sign, despite terminating her more than four months ago.

Dr. Susan McMahon filed a lawsuit Feb. 16 in U.S. District Court for the Western District of Pennsylvania against Refresh Dental Alliance, Professional Dental Alliance LLC, North American Dental Management LLC, Dr. Andrew Matta and Brittany Davis.

According to the complaint, after McMahon sold her dental practice to Refresh Dental Alliance in May 2012, she remained with the firm, performing cosmetic dentistry. The suit says after the plaintiff complained several times about Refresh’s cost-cutting practices, such as the hiring of untrained front-office staff, she was eventually terminated at the end of 2015.

Since then, the suit states, the practice still displays her name on the building’s signage and continues to book appointments for her. However, McMahon alleges, once patients show up for an appointment they are told she has retired and given other disparaging information allegedly designed to discourage patients from seeking her services.

McMahon seeks a jury trial and punitive and compensatory damages in an amount to be proven at trial, plus interest and litigation costs. She is represented by attorneys Jayme L. Butcher, Amy Joseph Coles and Louis David Abrams of Blank Rome LLP in Pittsburgh.
