PHILADELPHIA — A man is suing Xfinity Live! Philadelphia for allegations of race discrimination and wrongful termination.

John Nichols filed a lawsuit on March 23 in the U.S. District Court for the Eastern District of Pennsylvania against PL Phase One Operations LP, doing business as Xfinity Live! Philadelphia, citing violations of Title VII of the Civil Rights Act of 1964 and the Pennsylvania Human Relations Act.

According to the complaint, Nichols, an African-American individual, was employed by the defendant from Jan. 1, 2012, until May 23, 2014, working as a security officer and operations manager. During his employment, the plaintiff claims he was subjected to a relentless campaign of racism from his supervisors and coworkers, including numerous counts of racist verbal abuse and discrimination.

On May 2, 2014, the plaintiff alleges, he filed a complaint with the human resources coordinator regarding the unabated discriminatory conduct, but she failed to put a stop to the problem. Nichols claims he was then given an unjustly negative performance review, in what he believes to have been an act of retaliation, and was terminated on May 23, 2015. The plaintiff avers that he was fired on the basis of race and in retaliation for registering complaints of race discrimination.

Nichols seeks compensation for lost wages and benefits, front pay, punitive damages, compensatory damages, pre- and post-judgment interest, costs of suit, attorney and expert witness fees, and a trial by jury. He is represented by Sidney L. Gold of Sidney L. Gold & Associates PC, in Philadelphia.
