PHILADELPHIA – Former employees of the Mikmar Group are filing a class-action suit against the company, seeking damages for alleged failure to pay overtime compensation.

Keisha Henry and Tanika Brown, on behalf of themselves and all others similarly situated, filed a lawsuit on Feb. 29 in the U.S. District Court for the Eastern District of Pennsylvania against Mikmar Group Inc., citing violations of the Fair Labor Standards Act (FLSA) and the Pennsylvania Minimum Wage Act (PMWA).

According to the complaint, Mikmar Group operates a contracted package delivery carrier for FedEx Corp. in Eastern Pennsylvania. Henry was employed by the defendant as a driver from November 2012 to June 2013, and then from October 2014 to October 2015, the suit states. Brown was purportedly similarly employed as a driver from Nov. 21, 2014, to late 2015.

The plaintiffs claim that they regularly worked in excess of 40 hours per week without receiving overtime compensation. They aver that they, along with other members of the class, are due damages for the alleged violations of the FLSA and PMWA.

Henry and Brown seek class action classification, compensation for their lost wages, liquidated damages, and further relief.
