Man claims firing was tied to disability

PITTSBURGH — A former employee of Karndean Design Flooring is suing the company, alleging he was fired because his supervisor failed to make accommodations for his disability.

Allan M. Martin filed a lawsuit on March 31 in the U.S. District Court for the Western District of Pennsylvania against Karndean International LLC, doing business as Karndean Design Flooring, citing violations of the ADA and Title VII of the Civil Rights Acts of 1964 and 1991.

According to the complaint, Martin was hired by the defendant on Sept. 16, 2013, as a networking specialist. The plaintiff allegedly suffers from Sensory Integration Dysfunction neuromuscular weakness, resulting in insomnia, which he claims affected his work performance in a way that he repeatedly attempted to explain to his supervisor.

The plaintiff avers that he was terminated after his employer failed to make accommodations for his illness or let him work extra hours to compensate for missed time.

Martin seeks economic damages for all lost wages and benefits, compensatory damages, attorney’s fees, costs, punitive damages, and a trial by jury. He is represented by Richard C. Thiele in Greensburg, PA.
