Man sues well servicing company over allegations of overtime violations

PITTSBURGH — A former field employee for Killion and Sons Well Services Inc. is suing the company for allegedly failing to pay proper overtime compensation.

John Beloit filed a lawsuit on March 29 in the U.S. District Court for the Western District of Pennsylvania against Killion and Sons Well Service Inc., citing violations of the Fair Labor Standards Act, the Pennsylvania Wage Payment and Collection Law, and the Pennsylvania Minimum Wage Act.

The suit says Killion and Sons Well Service Inc. provides onsite services at gas and oil drilling sites in western Pennsylvania. According to the complaint, Beloit was employed by the defendant as a field employee from April 14, 2014, until Sept. 20, 2015. The plaintiff claims he worked a fixed schedule of 12 hours per day for nine consecutive days, followed by three days off.

Beloit avers that according to the schedule, he regularly worked in excess of 40 hours per week but was allegedly never paid overtime compensation.

Beloit seeks compensation for all unpaid wages, including overtime wage payment, interest, liquidated damages, litigation costs, expenses, and attorney's fees. He is represented by Samuel J. Pasquarelli of Sherrard, German & Kelly PC, in Pittsburgh.
