PHILADELPHIA – A Florida man is suing the owners of a farmers' market in Bryn Mawr for allegedly not having the structure readily accessible to the disabled.

Owen Harty filed a lawsuit March 3 in the U.S. District Court for the Eastern District of Pennsylvania against Rosemont Square Associates, L.P., a Pennsylvania limited partnership, alleging a violation of the Americans with Disabilities Act.

According to the lawsuit, Harty claims that he has been discriminated against and is continuing to be discriminated against by Rosemont Square Associates for failing to have accessible facilities, which the suit claims is a violation of the ADA.

Harty is seeking that Rosemont Square Associates make all readily achievable alterations to the property and that the facility be made readily accessible to and usable by individuals with disabilities, to the extent required by the Americans with Disabilities Act.

Harty, who is also seeking attorney’s fees, costs and litigation expenses, is being represented by attorney John F. Ward, Esq. of Roysford, Pa.
