HARRISBURG – A trucker is suing a wholesale grocery company in York, claiming he suffered injuries during a slip and fall at their offices due to an alleged wet steel staircase.

Freeman Holbdy and his wife, Korie Allen, filed a lawsuit March 3 in the U.S. District Court for the Middle District of Pennsylvania against C&S Wholesale Groceries, Inc. alleging negligence and loss of consortium.

On or about Feb. 9, 2015, Holbdy was driving his truck and was scheduled to make a delivery to C&S Wholesale’s warehouse in York, the suit says. He alleges he left the warehouse office to return to his tractor-trailer truck, got to the top step of the stair leading down to the parking lot, and slipped and fell all the way down the staircase.

The staircase was made out of steel and it was raining earlier in the day, the suit says. According to the lawsuit, the temperatures dropped causing the wet steel stairs to freeze, and Holbdy did not notice the ice prior to the fall. According to the claim, he suffered cervical back pain that required a fusion, pain in his left shoulder, left arm and left thigh.

In seeking an amount in excess of $75,000, he is seeking compensation for past, present, and future pain and suffering; past, present and future physical disability and past, present and future financial losses; lost wages and earning capacity; as well as general expenses and bills.

Holbdy and Allen,who are demanding a jury trial, are being represented by attorney Thomas Waffenschmidt of the Waffenschmidt Law Firm, L.L.C. of South Williamsport.
