HARRISBURG — A former employee of Mission Mobility LLC is suing the company for allegations of unpaid wages and breach of contract.

Katherine Gizinski filed a lawsuit on April 8 in the U.S. District Court for the Middle District of Pennsylvania against Mission Mobility LLC, citing breach of contract and violation of the Pennsylvania Wage Payment and Collection Law.

According to the complaint, Gizinski worked a a sales director for the defendant at all times relevant to the case. On March 25, 2015, the defendant allegedly furnished a new compensation overview for her position, including a gross salary of $90,000 plus commissions.

The plaintiff claims that by 2015, she was entitled to a gross salary of $117,000 plus additional supplemental compensation. Gizinski avers that she was only receiving 50% of her regularly scheduled paycheck, which she routinely received two weeks late. As a result, the plaintiff voluntarily separated from Mission Mobility on Oct. 25, 2015, and she claims the defendant still owes her compensation in the amount of $75,565.81.

Gizinski seeks judgment in the sum of $75,565.81, liquidated damages in the amount of $18,891.45, attorney’s fees, taxable costs, interest, and a trial by jury. She is represented by John M. Kerr of John Kerr Law, in Mechanicsburg, PA.
