PHILADELPHIA – A warehouse and distribution company has been sued for $1 million over a claim of gross negligence in the delivery of several rolls of paper.

METSA Board Americas Corporation, Norcell, Inc., Iggesund Paperboard AB and Iggesund Paperboard Inc. filed a lawsuit March 7 in the U.S. District Court for the Eastern District of Pennsylvania against Penn Warehousing and Distribution Inc. alleging breach of contract and gross negligence.

Prior to June 8, 2015, Penn Warehousing and Distribution, Inc. accepted and received quantities of reams or rolls or paper for METSA Board Americas as a public terminal, bailee or warehouseman, the suit says.

Penn Warehousing and Distribution, Inc. then accepted the material and, in consideration of certain agreed charges, agreed to store, care, handle and deliver the material in the same good order and condition as when it was delivered to them, according to the lawsuit.

According to the complaint, Penn Warehousing and Distribution Inc. failed to make delivery of the paper in the good order and conditions it was received.

The plaintiffs are seeking damages in a sum exceeding $1 million, together with interest and costs, and the legal fees and costs of bringing and maintaining the lawsuit.

The plaintiffs are being represented by attorney Jeffrey S. Pollack of Duane Morris, L.L.P. in Philadelphia.
