Toy company sued over claim of refusing to reimburse money

PHILADELPHIA – A company that manufactures technical toys for children is being sued for at least $88,000 over an allegation of not giving a full cash refund for returned merchandise.

QVC Inc. filed a lawsuit March 8 in the U.S District for the Eastern District of Pennsylvania against Tech 4 Kids Inc. alleging a breach of a purchase order.

On or about June 9, 2015, QVC Inc. revised a purchase order to Tech 4 Kids Inc. of no less than 4,999 units of ``3D Magic Creation Maker Kit with Bonus Accessories,” the suit says. The terms and conditions of the purchase order included a full credit or refund, according to the complaint.

According to the lawsuit, QVC Inc. returned the merchandise, in the aggregate amount of no less than $88,355, and Tech 4 Kids Inc. failed or refused to accept the return and delivery of the merchandise.

QVC Inc. is seeking a cash refund in the amount of no less than $88,355 and a reimbursement of its costs and expenses, including reasonable attorneys’ fees and costs of the lawsuit.

QVC Inc. is being represented by attorneys Nathaniel Metz, Amy S. Kline and Shanna L. Peterson of Saul Ewing, L.L.P. in Wayne.
