PHILADELPHIA — A former employee of a school bus fleet operator is suing the company for alleged violations of his Family and Medical Leave Act rights and wrongful termination.

Lonny Cooper filed a lawsuit on March 10 in the U.S. District Court for the Eastern District of Pennsylvania against Custer’s Garage Inc., citing violations of the FMLA.

According to the complaint, Cooper was employed by the defendant for approximately 15 years until December 2014. Beginning in March 2013, the plaintiff, who was eligible for FMLA leave, missed time from work to care for his wife, the suit says. The plaintiff claims he was disciplined by the plaintiff for attendance reasons and was wrongfully terminated on Dec. 17, 2014, in violation of his FMLA rights.

Cooper seeks back pay and benefits, reinstatement and/or front pay and benefits, interest in his monetary losses, liquidated damages, and attorneys’ fees. He is represented by Larry A. Weinberg and Derrick W. Cummings of McCarthy Weinberg Cummings PC, in Harrisburg.
