Electrician claims employer violated overtime-pay standards

PHILADELPHIA — An electrician has filed a class-action suit against a contractor, alleging failure to pay proper overtime wages.

William F. Roth, on behalf of himself and all other similarly situated, filed a lawsuit on April 14 in the U.S. District Court for the Eastern District of Pennsylvania against Neshaminy Electrical Contractors Inc., citing violations of the Fair Labor Standards Act (FLSA), the Pennsylvania Minimum Wage Act (PMWA), and the Pennsylvania Wage Payment and Collection Law (PWPCL).

According to the complaint, Roth was employed by the defendant, an electrical contracting services company, from approximately 1987 through January 2015. The plaintiff and the collective class generally report to the Bensalem location before traveling to work assignments, the suit says.

From approximately May thought August 2014, the plaintiff claims he worked on a job site in Richmond, Virginia, and was never compensated for overtime work or travel time. Roth avers that the defendant has maintained improper pay practices like this throughout his employment period in violation of the FLSA, PMWA, and the PWPCL.

Roth seeks collective action designation, damages for unpaid compensation, liquidated damages, interest, and litigation costs. He is represented by Scott M. Pollins, in Swarthmore.
