Roller coaster rider sues amusement park

PHILADELPHIA — An amusement park patron is suing over allegations that he was injured aboard a roller coaster.

Chetan Bhavsar filed a complaint on April 19, in the U.S. District Court for the Eastern District of Pennsylvania against Clementon Park and Splash World, Clementon Amusement Park, Clementon Lake Holdings LLC, Premier Parks LLC, Philadelphia Toboggan Company, S&S Worldwide Inc., S&S Worldwide of Utah, and S&S Power Inc, citing alleged negligence.

Bhavsar alleges that the defendants failed to make sure that the "Hell Cat" ride was in good condition and safe for the amusement park patrons.

According to the complaint, the plaintiff alleges that, on Aug. 18, 2014, he rode the wooden roller coaster known as Hell Cat ride. During the ride, his torso went forward due to "g-forces" and his head hit the exposed wooden seatback in front of him, the suit says.

This allegedly resulted in serious and permanent injuries. The plaintiff holds Clementon Park and Splash World, Clementon Amusement Park, Clementon Lake Holdings LLC, Premier Parks LLC, Philadelphia Toboggan Company, S&S Worldwide Inc., S&S Worldwide of Utah, and S&S Power Inc. responsible because the defendants allegedly failed to do necessary inspection, maintenance and repair and provide safety gear and/or devices before allowing people to ride the roller coaster. Furthermore, the defendants also did not issue warnings and instructions with regard to taking the ride, the suit claims.

The plaintiff requests a trial by jury and seeks compensatory damages in an amount in excess of $75,000, and in excess of the arbitration limits of this court, together with interest, costs, and compensation for delay.
