Woman says debt collector violated telephone law

PITTSBURGH — A consumer is suing Medicredit Inc., a debt collection company, citing alleged violation of telephone harassment statutes.

Vicky Dennison filed a complaint on April 12, in the U.S. District Court for the Western District of Pennsylvania against Medicredit Inc. alleging that the debt collection company continuously called and harassed plaintiff to settle the payment for her medical bill debt.

According to the complaint, the plaintiff alleges that, in April 2015, she received calls from the defendant demanding that she pay her debt. Though plaintiff explained that she was unemployed that time, defendant still contacted her repeatedly, which made her feel uneasy and harassed, the suit says. The plaintiff holds Medicredit, Inc. responsible because the defendant allegedly ignored plaintiff's declaration that she was not able to settle the payment yet because she didn't have work that time. Defendant also did not notify plaintiff of valuable information with regard to her debt, the suit alleges.

The plaintiff requests a trial by jury and seeks all actual damages suffered, statutory damages of $1,000 for the violation of the FDCPA, all reasonable attorneys’ fees, witness fees, court costs and other litigation costs incurred by the plaintiff, and any other relief deemed appropriate by the court. She is represented by Craig Thor Kimmel of Kimmel Silverman, P.C. in Ambler.
