Man says insurer improperly halted benefits

PITTSBURGH — A man is suing an insurance company, claiming that it improperly denied disability benefits to him.

Stephen Peat filed a complaint on April 13 in the U.S. District Court for the Western District of Pennsylvania against Lincoln National Life Insurance Company alleging that the payor of benefits wrongfully terminated his benefits.

According to the complaint, the plaintiff alleges that, from January 2013 to the present date, he did not receive benefits to which he was entitled under a long-term disability policy. As a result, he suffered actual harm, the suit says. The plaintiff holds Lincoln National Life Insurance Company responsible because the defendant allegedly wrongfully terminated his benefits, made no inquiry as to where he actually resided, refused to consider additional information and violated the full and fair review provisions of the Employee Retirement Income Security Act.

The plaintiff requests a trial by jury and seeks judgment in his favor and against defendant, payment for all benefits due under the plan, attorneys’ fees, costs of suit and an award for all such other relief as the court deems just and proper.
