PITTSBURGH — A pipeline inspector has filed a class-action lawsuit against Quality Integrated Services Inc., a third-party services provider, citing alleged unjust enrichment and violation of wage law.
Jesse Webb filed a complaint on behalf of all persons similarly situated on April 15 in the U.S. District Court for the Western District of Pennsylvania against Quality Integrated Services Inc. alleging that the third-party services provider violated the Fair Labor Standards Act and Pennsylvania law through its practice of not paying its day rate employees overtime compensation.
According to the complaint, the plaintiff alleges that, between October 2010 and September 2014, he routinely worked up to seven days per week, between 16 and 18 hours per day, without proper overtime compensation for hours worked over 40 per week. The plaintiff holds Quality Integrated Services Inc. responsible because the defendant allegedly paid him straight time for every hour over 10 in a day and failed to properly compensate him for all hours worked in excess of 40 during the workweek at a rate not less than one and one-half times the regular rate.
The plaintiff requests a trial by jury and seeks an order permitting this litigation to proceed as an FLSA collective action, compensation for back pay damages, pre-judgment interest , liquidated damages, litigation costs, expenses, and attorneys’ fees and such other relief as the court deems just and proper.
