PHILADELPHIA — A former carpenter for ABC Capital Investments has filed a class-action suit against the company over allegations of failure to pay proper overtime compensation and retaliation that he claims led to his termination.

Winston Robinson, on behalf of himself and all others similarly situated, filed a lawsuit on April 27 in the U.S. District Court for the Eastern District of Pennsylvania against ABC Capital Investments LLC, citing violations of the Fair Labor Standards Act, the Pennsylvania Minimum Wage Act, and the Pennsylvania Wage Payment and Collection Law.

According to the complaint, Robinson was hired by the defendant in December 2013 as a carpenter and was compensated on a piece-rate basis, receiving a predetermined flat rate for each task performed. The plaintiff claims he regularly worked in excess of 40 hours per week without receiving overtime compensation.

The suit states that the defendants did not properly track or classify its employees and failed to lawfully provide compensation for all hours worked. The plaintiff further claims that he was terminated in retaliation for his complaints about payment policies.

Robinson seeks class-action designation and compensation for all lost wages and benefits, on behalf of himself and all member of the class.
