PITTSBURGH – A pizza chain is suing a former franchisee over a claim of trademark infringement.

Fox’s Pizza Den Inc. filed a lawsuit April 26 in the U.S. District Court for the Western District of Pennsylvania against Sean L.L.C., Sarvar Muratov and Sarvar Tadjikhodjayev alleging federal trademark infringement, federal unfair competition, common law trademark infringement and common law unfair competition.

According to the lawsuit, Muratov and Tadjikhodjayev at one time operated a legitimate Fox’s Pizza Den franchise that was terminated on May 26, 2015 when they defaulted on their obligations.

However, according to the claim, Muratov and Tadjikhodjayev surreptitiously continued to operate a pizza shop under the Fox’s Pizza Den name, selling pizza and related food items specifically using the actual registered trademark of Fox’s Pizza Den.

Fox’s Pizza Den Inc. is seeking a preliminary and permanent injunction to stop Muratov and Tadjikhodjayev from selling pizza and related food items under the actual registered trademark of Fox’s Pizza Den as well as asking the court to impound all counterfeit and infringing merchandise.

Fox’s Pizza Den Inc. is being represented by attorney Jeffrey R. Owen of Cooper Owen & Renner, P.C. of Murrysville.
