HARRISBURG – A former conductor for a railway service is suing his ex-employer over a claim that he has suffered lasting trauma to his lower body due to unsafe work conditions.
Paul Leshinski filed a lawsuit April 11 in the U.S. District Court for the Middle District of Pennsylvania against Delaware and Hudson Railway Company Inc., doing business as CP Rail System, alleging a violation of the Federal Employers' Liability Act and negligence.
According to the claim, while working as conductor for CP Rail System, Leshinski was injured due to exposure to repetitive traumas to his upper and lower extremities and shoulders, back and neck because of CP Rail System’s failure to provide him with a safe workplace during his employment, such as proper seating and even ground.
Leshinski is seeking a judgment of $100,000, plus interest and costs.
Leshinski, who is demanding a jury trial, is being represented by attorney Gerard J. Martillotti of Jerry Martillotti & Associates in Philadelphia.
