PITTSBURGH — A Butler resident is suing Citibank, N.A., a financial services company, citing alleged violation of telephone harassment statutes.
Lynn Flack filed a complaint on April 26, in the U.S. District Court for the Western District of Pennsylvania against Citibank, N.A. alleging that the financial services company failed to acknowledge and accede to the plaintiff's request to stop calling his mobile phone multiple times a day.
According to the complaint, the plaintiff alleges that he has received frequent calls from the defendant using an automatic telephone dialing system, and that despite his request on Jan. 6 to cease such conduct, the defendant allegedly still continued to call the plaintiff several times a day, which left him annoyed and harassed. The plaintiff holds Citibank, N.A. responsible because the defendant allegedly willfully placed calls to the plaintiff's cellular phone in spite of the request to stop. Defendant was allegedly fully aware that it was using an automatic telephone dialing system to make these calls.
The plaintiff seeks an award of $500.00 in statutory damages; an award of $1500.00 in statutory damages; all court costs, witness fees and other fees incurred; and any other relief that the court deems appropriate. He is represented by Adam T. Hill of Krohn & Moss Ltd. in Chicago.
