PHILADELPHIA — A Georgia corporation is suing Hollis Thomas, a Philadelphia resident, citing alleged breach of contract and unjust enrichment.

Old Ivy Capital Partners LLC filed a complaint on April 25 in the U.S. District Court for the Middle District of Pennsylvania against Thomas, alleging that the Philadelphia resident allegedly failed to comply with a promissory note agreement.

According to the complaint, the plaintiff alleges that it has suffered damages for non-collection of debt in an amount of $215,000, excluding interest. The plaintiff holds Thomas responsible because the defendant allegedly breached the repayment terms of the promissory note and defaulted, failing and refusing to tender payment for the promissory notes due.

The plaintiff requests a trial by jury and seeks judgment against the defendant for damages amounting to $215,000, plus interest, attorneys' fees and costs. It is represented by Gerald S. Berkowitz and Robert A. Klein of Berkowitz Klein LLP in Malvern.
