Company accused of infringing former Carnegie Mellon professor's patent

PITTSBURGH — A patent owner has filed suit against Western Digital for alleged patent infringement.

Lambeth Magnetic Structures LLC filed a complaint May 2 in U.S. District Court for the Western District of Pennsylvania against Western Digital Corporation and related companies, alleging that they allegedly violated U.S. Patent Law.

According to the complaint, the plaintiff, a limited liability corporation that houses patents created by a retired Carnegie Mellon professor, alleges that it has been damaged by the defendant's infringement of Patent No. 7,128,988, entitled “Magnetic Material Structures, Devices and Methods" and is suffering and will continue to suffer irreparable harm and damage as a result of this infringement unless such infringement is enjoined by the court. 

The plaintiff holds Western Digital Corporation and others responsible because the defendants allegedly directly infringed the ‘988 Patent by importing, manufacturing, using, selling and offering to sell magnetic heads similar to the '988 Patent.

The plaintiff requests a trial by jury and seeks a permanent injunction enjoining the defendants from infringing upon the ‘988 Patent, compensation for all damages, pre- and post-judgment interest, attorneys’ fees, expenses and costs, and for such other and further equitable or legal relief.
