PHILADELPHIA — A woman is suing Stern & Eisenberg PC, a debt collector, citing alleged violation of telephone harassment statutes.

Wanda Lewis filed a complaint on May 4 in the U.S. District Court for the Eastern District of Pennsylvania against Stern & Eisenberg PC, alleging that the debt collector allegedly violated the Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges that on or around October 15, 2015, her lawyer wrote to the defendant to provide notice of representation, but frequent collection calls continued. As a result of the defendant's acts, she has sustained actual damages, including, but not limited to, injury to her reputation, invasion of privacy, damage to credit, out-of-pocket expenses, physical, emotional and mental pain and anguish and pecuniary loss, the suit says. The plaintiff holds Stern & Eisenberg PC responsible because the defendant allegedly acted in a false, deceptive, misleading and unfair manner by communicating with her when they thew knew that she is being represented by counsel.

The plaintiff requests a trial by jury and seeks compensation for actual damages, statutory damages, costs and reasonable attorney’s fees and such other and further relief as may be necessary, just and proper. She is represented by Mark Mailman and Erin A. Novak of Francis & Mailman PC in Philadelphia.
