PHILADELPHIA — A man is suing Bayview Loan Servicing LLC, a credit reporting agency, citing an alleged breach of a settlement agreement and false credit reporting.

Sherwood Dejoie of Lehigh County filed a complaint on May 5 in the U.S. District Court for the Eastern District of Pennsylvania against Bayview Loan Servicing LLC, alleging that the credit reporting agency violated the Fair Credit Reporting Act.

According to the complaint, the plaintiff alleges that as of Jan. 12, his credit report past due amount balance was zero, but on March 30 his credit report reverted back to the prior inaccurate past due amount of $8,472, with an incorrect monthly payment of $2,069. As a result, his agreement with a real estate company was rescinded after the firm saw the false and incorrect information regarding an alleged $8,472 past due on his mortgage, causing him to loose the opportunity to purchase real estate at a bargain price. The plaintiff holds Bayview Loan Servicing LLC responsible because the defendant allegedly discriminated against him based on his race and color, engaged in misrepresentation by intentionally reporting two past due amounts on his mortgage and failed to notify him of any determination that his dispute was frivolous.

The plaintiff requests a trial by jury and seeks judgment with a grant of compensatory damages, punitive damages and such other relief as the court deems just and necessary. He is represented by Nikolaus Baikow of Baikow Legal in Allentown.
