Good Old Days Bar accused of unauthorized music performances

HARRISBURG – Copyright owners allege that a Bloomsburg restaurant publicly performed their songs without authorization.

Broadcast Music Inc., Sony/ATV Acuff Rose Music, Welsh Witch Music, Interior Music Corp., Paul Simon Music, Songs of Universal Inc., Escatawpa Songs, Sony/ATV Songs LLC filed a complaint on May 11, in the U.S. District Court for the Middle District of Pennsylvania against Bar-B-Q-Corp, doing business as Good Old Days Bar, Sharon Babb and Thomas X. Flaherty alleging that they allegedly violated the U.S. Copyright Act.

According to the complaint, the plaintiffs allege that they suffered and will continue to suffer irreparable injuries unless and until a decision is rendered in their favor. The plaintiffs holds Bar-B-Q-Corp, Sharon Babb and Thomas X. Flaherty responsible because the defendants allegedly publicly preformed plaintiffs' copyrighted musical compositions without license or authorization.

The plaintiffs request a trial by jury and seek an order enjoining and restraining defendants from infringing copyrighted musical compositions licensed by BMI; an order to pay statutory damages, attorney's fees and costs; and such other relief as is just and equitable. They are represented by Stanley H. Cohen of Caesar Rivise PC in Philadelphia.
