PHILADELPHIA — A married couple's lawsuit against Boscov's Inc., a retail store operator, cites alleged disability discrimination, failure to accommodate, retaliation and wrongful termination.
Ian Ueda and Amanda Ueda of Lebanon filed a complaint on May 23 in the U.S. District Court for the Eastern District of Pennsylvania against Boscov's Inc., alleging that the retail store operator violated the Americans with Disabilities Act and the Pennsylvania Human Relations Act.
According to the complaint, the plaintiffs allege that due to Ian Ueda's epilepsy, they both needed to take leave from work. Shortly after Ian Ueda reported to work as a security guard on April 13, 2013, they were fired and were advised that the firings were due to Ian Ueda's use of a box cutter on March 28, 2013, the suit says. As a result of the defendant’s unlawful actions, the plaintiffs say, they have suffered damages. The plaintiffs hold Boscov's Inc. responsible because the defendant allegedly failed to grant reasonable accommodation without undue hardship, fired plaintiff Ian Ueda because of his disability and/or his need for accommodation and fired plaintiff Amanda Ueda because of her association with an individual with a disability.
The plaintiffs request a trial by jury and seek an order prohibiting the defendant from continuing its illegal policy of discriminating against employees based on their disabilities and/or perceived disabilities, an award for all damages, costs and expenses of this action and reasonable legal fees as provided by applicable law.
