PENNSYLVANIA — A Doylestown man is suing Sears, Roebuck and Co., citing alleged design defect, liability and product liability.

Gerard Gifford filed a complaint on May 24 in the U.S. District Court for the Eastern District of Pennsylvania against the defendant, alleging that Sears distributed a defective product.

According to the complaint, the plaintiff alleges that on July 2, 2015, a freezer had had purchased from Sears caught fire in his home and damaged his property. The plaintiff holds Sears, Roebuck and Co. responsible because the defendant allegedly failed to properly inspect its product for any defects and provide adequate warning for consumers on how to protect against the risk of harm.

The plaintiff seeks judgment against the defendant in an amount in excess of $900,000 plus court costs and any further relief the court sees fit. He is represented by Raymond E. Mack and Patrick Hughes of De Luca Levine LLC in Blue Bell.
