Philadelphia resident accuses Around the Clock Home Health Care Services of violation of FLSA

PHILADELPHIA — A home health aide has filed a class-action lawsuit against Around the Clock Home Health Care Services, an employer, claiming the company improperly failed to pay her for overtime hours and travel time.

Gloria Velez Morales filed a complaint on May 25, in the U.S. District Court for the Eastern District of Pennsylvania against Around the Clock Home Health Care Services.

According to the complaint, the plaintiff alleges that between July 2013 and February 2016, she regularly worked more than 40 hours per week and incurred travel time but was not compensated by law for hours worked in excess of 40 per week, and she holds the defendant responsible for allegedly failing to obey wage laws.

The plaintiff requests a trial by jury and seeks back pay damages, all unpaid overtime wages, unpaid wages, interest, liquidated damages, court costs and any further relief the court grants. She is represented by Shanon J. Carson, Sarah R. Schalman-Bergen, Alexandra K. Piazza and Camille Fundora of Berger & Montague, P.C. and Michael Hollander of Community Legal Services in Philadephia.
