PHILADELPHIA — A consumer has filed a class-action lawsuit against Samsung Electronics America Inc. and Samsung Electronics Co. Ltd., alleging breach of implied warranty, design defect, failure to warn, negligence and product liability.

Rose Wagner filed a complaint on June 30 in the U.S. District Court for the Eastern District of Pennsylvania against the defendants, alleging that they knowingly manufactured defective products and distributed them to consumers.

According to the complaint, the plaintiff alleges that, in 2015, she purchased a defective washing machine that caused approximately $25,000 worth of damage to her home. The plaintiff holds the defendants responsible because they defendants allegedly had knowledge of the defects of their product but chose not to disclose this to consumers or to make an effort to rectify the issues by offering free replacements and service for existing products.

The plaintiff requests a trial by jury and seeks injunctive relief against the defendants, payment of all damages, restitution, interest, court costs and any further relief the court grants. She is represented by Shanon J. Carson and Michael Fantini of Berger & Montague, P.C. in Philadelphia, Gregory F. Coleman and Lisa A. White of Greg Coleman Law PC in Knoxville , Tennessee, and Edward A. Wallace, Amy E. Keller and Tyler J. Story of Wexler Wallace LLP in Chicago.
