PHILADELPHIA — Several labor group funds are suing 3-R Painting Company LLC, an employer, citing alleged breach of contract for failing to pay contributions for its employees.

International Union of Painters and Allied Trades District Council No. 21 Health and Welfare Fund, International Union of Painters and Allied Trade District Council No. 21 Annuity Fund, International Union of Painters and Allied Trades District Council No. 21 Job Recovery Fund, International Union of Painters and Allied Trades District Council No. 21 Apprentice Fund, International Union of Painters and Allied Trades District Council No. 21 Industry Advancement Fund, International Union of Painters and Allied Trades District Council No. 21 Vacation Fund, International Union of Painters and Allied Trades District Council No. 21 Scholarship Fund, International Union of Painters and Allied Trades District Council No. 21 Finishing Trades of the Mid-Atlantic Region, Joseph Ashdale, Trustee, and International Union of Painters and Allied Trades District Council No. 21 filed a complaint on April 15 in the U.S. District Court for the Eastern District of Pennsylvania against 3-R Painting Company, LLC alleging that the employer failed to pay monthly contributions to the labor group.

According to the complaint, the plaintiffs allege that, between August 2013 and September 2013, the plaintiffs suffered damages as a result of unpaid contibutions. The plaintiffs hold the defendant responsible for allegedly failing to pay monthly contributions on behalf of its employees to the labor group.

The plaintiffs seek all amounts due and owing, accounting and audit of all amounts due, liquidated damages, court costs and any further relief the court grants. They are represented by Nicholas J. Botta of Spear Wilderman, P.C. in Philadelphia.
