Woman hit by golf ball alleges negligence, carelessness

PHILADELPHIA — A woman is suing Daniel Gardner, Applecross Club Operations LLC d/b/a Applecross Country Club, Pultegroup Inc., Pulte Homes of Pennsylvania L.P., and Pulte Homes Corporation of the Delaware Valley, alleging that negligence and insufficient measures taken to prevent injuries led to her being struck in the head by a golf ball hit by Gardner.

Kyle Roth filed a complaint on July 6 in the U.S. District Court for the Eastern District of Pennsylvania against the defendants, alleging that she was injured due to their negligence and carelessness.

According to the complaint, the plaintiff claims the incident occurred on July 6, 2014, and she holds the defendants responsible for allegedly failing to take certain precautions to safeguard people in an outdoor dining area.

The plaintiff requests a trial by jury and seeks judgment against the defendants in an amount in excess of $75,000 plus interest, delay damages, court costs and any further relief this court grants. She is represented by Sean E. Quinn of Quinn Law Group, LLC in Philadelphia.
