Union funds seek contributions from employer

PITTSBURGH — Several labor union funds are suing Luffy Masonry LLC, an employer, citing alleged breach of contract.

Laborer's Combined Funds of Western Pennsylvania, as agent for Philip Ameris, and Paul V. Scabilloni, trustees ad litem, Laborers' District Council of Western Pennsylvania Welfare and Pension Funds, the Construction Industry Advancement Program of Western Pennsylvania Fund, and the Laborers' District Council of Western Pennsylvania and its affiliated local unions filed a complaint on July 15 in the U.S. District Court for the Western District of Pennsylvania against Luffy Masonry LLC, alleging that the employer failed to pay contributions to the plaintiffs.

According to the complaint, the plaintiffs allege that they sustained damages as the result of unpaid contributions. The plaintiffs hold Luffy Masonry LLC responsible because the defendant allegedly failed to pay monthly contributions to the labor funds on behalf of its employees.

The plaintiffs seek an order of immediate payment of all monies past due, an order for the defendant to file complete reports, all monies owed to plaintiffsplus interest and liquidated damages at 10 percent times the principal amount, all legal fees equal to 20 percent of total delinquency but not less than $1,000, plus court costs and any further relief the court grants. They are represented by Neil J. Gregorio and Jeffrey J. Leech of Tucker Arensberg, P.C. in Pittsburgh.
