Woman says drug dangers weren't revealed

PHILADELPHIA — A consumer is suing Johnson & Johnson and Janssen Pharmaceuticals Inc., pharmaceutical companies, citing alleged breach of implied warranty, design defect, failure to warn, fraud, negligence, and negligent misrepresentation.

Louise Bredice filed a complaint on July 15 in the U.S. District Court for the Eastern District of Pennsylvania against the defendants, alleging that they failed to provide adequate warnings on the labels of Levaquin.

According to the complaint, the plaintiff alleges that she was diagnosed with irreversible peripheral neuropathy which was caused by taking Levaquin. The plaintiff holds the defendants responsible because they allegedly had knowledge about the potential risk Levaquin could cause to consumers but chose not to include this on the drug's label.

The plaintiff requests a trial by jury and seeks general and special damages, all medical expenses, interest, full refund of all purchase cost of Levaquin, compensatory damages, consequential damages, punitive damages, court costs and any further relief the court grants. She is represented by David L. Friend of Hissey Kientz, LLP in Austin, Texas.
