PHILADELPHIA — A New Jersey woman is suing Life Insurance Company of North America, an insurance firm, claiming violation of the Employee Retirement Income Security Act.

Kathleen Delaney filed a complaint on July 14 in the U.S. District Court for the Eastern District of Pennsylvania against Life Insurance Company of North America, alleging that the insurance firm improperly denied her claim for long-term disability benefits.

According to the complaint, the plaintiff alleges that in 2007, she became disabled and was initially paid disability benefits until they were terminated on May 30, 2014. The plaintiff holds the insurer responsible because it allegedly terminated the benefits to the plaintiff despite her several appeals and despite adequate medical records to support her claim.

The plaintiff seeks disability benefits, interest, court costs and any further relief the court grants. She is represented by Joseph Capitan of Martin Law in Philadelphia.
