Company accused of not paying proper overtime

PHILADELPHIA — An employee has filed a class-action lawsuit against Top Choice Home Care LLC, claiming the employer has failed to pay proper overtime compensation.

Vanessa Bright filed a complaint on July 18, in the U.S. District Court for the Eastern District of Pennsylvania against Top Choice Home Care LLC, alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that she often works more than 40 hours per week, and that it is the practice of the defendant to pay straight time for all hours worked, regardless of the number per week. The plaintiff holds the defendant responsible for allegedly failing to pay time and a half for hours worked in excess of 40 per week.

The plaintiff requests a trial by jury and seeks unpaid wages plus interest, liquidated damages, court costs and any further relief the court grants. She is represented by Peter Winebrake, R.
