Woman alleges she was denied job because of inaccurate Checkr report

PHILADELPHIA – A Philadelphia resident has filed a class-action suit against a consumer reporting agency alleging its inaccurate report cost her a job.

Deatri Scott filed a complaint on behalf of and all others similarly situated on July 20 in the U.S. District Court for the Eastern District of Pennsylvania against Checkr Inc. alleging violation of the Fair Credit Reporting Act.

According to the complaint, the plaintiff alleges that in 2014, she lost a potential job due to the inaccurate consumer report given to her potential employer by the defendant. The plaintiff holds Checkr Inc. responsible because the defendant allegedly reported inaccurate charges that were filed against plaintiff that had already been nolle prossed and expunged from public record to plaintiff's potential employer, causing management to deny employment to plaintiff.

The plaintiff requests a trial by jury and seeks judgment against the defendant for statutory damages in the amount of not less than $100 but not more than $1,000 per violation per class member, actual damages, punitive damages, court costs and any further relief the court grants. She is represented by James A. Francis and David A. Searles of Francis & Mailman PC in Philadelphia.
