Woman claims she should be paid disability benefits

Insurance 09

PITTSBURGH — A woman is suing Aetna Life Insurance Company, an insurance firm, alleging violation of the Employee Retirement Income Security Act.

Pamela Merkle filed a complaint on July 20 in the U.S. District Court for the Western District of Pennsylvania against Aetna Life Insurance Company, alleging that the insurer denied her claim for long-term disability benefits.

According to the complaint, the plaintiff alleges that in 2012 she became unable to perform her work due to symptoms associated with major depressive disorder, generalized anxiety disorder and agoraphobia with panic disorder and applied for a claim for benefits, but was denied on Aug. 19, 2013. The plaintiff holds Aetna Life Insurance Company responsible because the defendant allegedly denied the plaintiff's claim for benefits despite her being disabled according to the terms of the plan.

The plaintiff seeks all relief to which she is entitled, interest, court costs and any further relief the court grants. She is represented by Brian Patrick Bronson of Quatrini Rafferty, P.C. in Greensburg.
