Woman claims pay was beneath minimum wage

PITTSBURGH — A former employee has filed a class-action lawsuit against Brinker International Inc., alleging violation of wage laws.

Nicole Augustine filed a complaint on July 22 in the U.S. District Court for the Western District of Pennsylvania against Brinker International Inc. alleging that the employer failed to fairly compensate the plaintiff and other employees.

According to the complaint, the plaintiff alleges that between 2012 and 2014, she was paid an hourly rate below the legal minimum wage. The plaintiff holds Brinker International Inc. responsible because the defendant allegedly failed to pay the plaintiff the legal minimum wage of $7.25 per hour.

The plaintiff requests a trial by jury and seeks unpaid minimum wages, interest, liquidated damages, court costs and any further relief this court grants. She is represented by Peter Winebrake, R. Andrew Santillo and Mark J. Gottesfeld of Winebrake & Santillo, LLC in Dresher and Jerry Martin of Barrett Johnston Martin & Garrison LLC in Nashville, Tennessee.
