PITTSBURGH — Several labor funds are suing Chick's Concrete Inc. a/k/a Chick's Concrete, an employer, citing alleged breach of contract.

Laborers' Combined Funds of Western Pennsylvania, as agent for Philip Ameris and Paul V. Scabilloni, trustees ad litem, Laborers' District Council of Western Pennsylvania Welfare and Pension Funds, the Construction Industry Advancement Program of Western Pennsylvania Fund, and the Laborers' District Council of Western Pennsylvania and its affiliated local unions filed a complaint on July 15 in the U.S. District Court for the Western District of Pennsylvania against Chick's Concrete Inc. a/k/a Chick's Concrete, alleging that the employer failed to pay monthly contributions to the labor funds.

According to the complaint, the plaintiffs allege that they suffered damages as the result of unpaid contributions. The plaintiffs hold the defendant responsible for allegedly failing to pay contributions on behalf of its employees as called for in a bargaining agreement.

The plaintiffs seek an injunction enjoining the defendant from violating the agreement, an order for the defendant to file a complete report, money judgment in the sum of all amounts owed plus interest on the principal amount at the rate of 1.25 percent per month, liquidated damages at 10 percent times the principal amount owed, auditing fees not less than $1,000, court costs and any further relief the court grants. They are represented by Jeffrey J. Leech and Neil J. Gregorio of Tucker Arensberg, P.C. in Pittsburgh.
