PITTSBURGH — Labor union funds are suing Panthers Sales Inc., alleging breach of contract.
Greg Christy and William C. Ligetti, on behalf of the Trustees of the Iron Workers Welfare Plan of Western Pennsylvania, Iron Workers of Western Pennsylvania Pension Plan and the Iron Workers of Western Pennsylvania Profit Sharing Plan, and as agents for The Iron Workers Employers Association of Western Pennsylvania Inc. and The International Association of Bridge, Structural and Ornamental Iron Workers, Local Union No. 3, AFL-CIO, filed a complaint on Aug. 3 in the U.S. District Court for the Western District of Pennsylvania against Panthers Sales Inc. alleging that the employer failed to pay monthly contributions to the labor funds on time.
According to the complaint, the plaintiffs allege that they suffered damages as the result of unpaid contributions. The plaintiffs holds Panthers Sales Inc. responsible because the defendant allegedly failed to pay monthly contributions to plaintiff on behalf of its employees under terms of a contract.
The plaintiffs seek an injunction against the defendant, a requirement for the defendant to file complete and accurate remittance reports with the plaintiff, an order for the defendant to present for audit, money judgment in the sum of $34,597.66, plus additional amounts shown to be owed tothe plaintiffs until termination of this case, plus liquidated damages, attorneys' fees of 20 percent of total amount due and costs of suit, an order for the defendant to either make a cash deposit of $20,000 or post a surety bond of $20,000, and any further relief the court grants.
