PITTSBURGH — A former employee has filed a class-action lawsuit against Encompass Services L.L.C., alleging violation of federal, Pennsylvania and Massachusetts wage laws.

Randy McDonald filed a complaint on Aug. 10 in U.S. District Court for the Western District of Pennsylvania against Encompass Services L.L.C., alleging that the employer failed to fairly compensate him for all his hours worked.

According to the complaint, the plaintiff alleges that he worked for more than 40 hours per week but was not properly paid for overtime. The plaintiff holds Encompass Services L.L.C. responsible because the defendant allegedly misclassified him in order to avoid paying him any overtime premiums.

The plaintiff requests a trial by jury and seeks unpaid back wages, liquidated damages, treble damages, interest, court costs and any further relief the court grants. He is represented by Joshua P. Geist of Goodrich & Geist, P.C. in Pittsburgh, Michael A. Josephson, Andrew W. Dunlap, Lindsay R. Itkin and Jessica M. Bresler of Fibich, Leebron, Copeland Briggs & Josephson in Houston and Richard J. (Rex) Burch of Bruckner Burch, P.L.L.C. in Houston.
