Couple seek payout from insurance policy

HARRISBURG — A couple's lawsuit against Progressive Direct Insurance Company alleges failure to pay benefits and loss of consortium.

Amy C. Snyder and Gary Foster filed a complaint on Aug. 12 in U.S. District Court for the Middle District of Pennsylvania against Progressive Direct Insurance Company, alleging that the insurance firm failed to pay under the terms of its underinsured motorist coverage.

According to the complaint, the plaintiffs allege that on Dec. 24, 2015, the vehicle they were in was rear-ended and pushed into another collision because of negligent driving by Kristen Smith, whose inadequate Nationwide insurance policy paid to the limit of its coverage. Snyder and Foster allege that the Progressive insurance on their vehicle should pay benefits under its underinsured motorist provisions, and are suing for that compensation.

The plaintiffs seek judgment against the defendant in an amount in excess of $75,000 plus interest, court costs and any further relief the court deems just. They are represented by David L. Lutz of Handler Henning & Rosenberg, LLP in Harrisburg.
