Companies face accusation of violating telephone law

PITTSBURGH — A man has filed a class-action lawsuit against Guardian Protection Services Inc. and Security Force Inc., citing alleged violation of telephone harassment statutes.

Mark Fitzhenry filed a complaint on Aug. 18 in the U.S. District Court for the Western District of Pennsylvania against the defendants, alleging that they made telemarketing phone calls to his cell phone.

According to the complaint, the plaintiff alleges that in 2015 and 2016, he received telemarketing and advertising calls, and he holds the defendants responsible for allegedly using an automatic telephone dialing system to contact him in violation of the law.

The plaintiff seeks injunctive relief prohibiting such violations in the future, $1,500 for each and every call as treble damages, $500 in statutory damages for each and every call, court costs and any further relief the court grants. He is represented by Clayton S. Morrow of Morrow & Artim, PC in Pittsburgh.
