Labor organizations say company didn't make contributions

PITTSBURGH — Labor unions and funds are suing Mon Valley Construction Co. Inc., an employer, alleging breach of contract.

Laborers' Combined Funds of Western Pennsylvania, as agent for Philip Ameris, and Paul V. Scabilloni, trustees ad litem, Laborers' District Council of Western Pennsylvania Welfare and Pension Funds, the Western Pennsylvania Heavy & Highway Construction Advancement Fund, and the Laborers' District Council of Western Pennsylvania and its affiliated local unions filed a complaint on July 29 in the U.S. District Court for the Western District of Pennsylvania against Mon Valley Construction Co., Inc. alleging that the employer failed to make their monthly payments to the labor group.

According to the complaint, the plaintiffs allege that they suffered damages from unpaid contributions. The plaintiffs holds Mon Valley Construction Co. Inc. responsible because the defendant allegedly failed to make monthly payment for contribution to the labor organizations on behalf of its employees based on an agreement.

The plaintiffs seek an order requiring the defendant to file complete reports, money judgment plus interest on the principal amount at the rate of 1.25 percent per month, liquidated damages, auditing costs and court costs equal to 20% of the total delinquency but not less than $100,000 and any further relief the court grants. They are represented by Jeffrey J. Leech and Neil J. Gregorio of Tucker Arensberg, P.C. in Pittsburgh.
