HARRISBURG — Labor funds are suing Accutech Testing & Balancing LLC, citing alleged breach of contract.
Warrent Faust and Lori Eshenaur, as trustees of the Sheet Metal Workers Local 44 Retirement Income Plan, Sheet Metal Workers Local 44 Annuity Fund, Sheet Metal Workers Local 44 Welfare Fund and Sheet Metal Industry Education Fund, filed a complaint in the U.S. District Court for the Middle District of Pennsylvania against Accutech Testing & Balancing LLC, alleging that the employer failed to make its monthly payments for contributions to the labor funds.
According to the complaint, the plaintiffs allege that they suffered damages from unpaid contributions. The plaintiffs hold Accutech Testing & Balancing LLC responsible because the defendant allegedly failed to pay its monthly contributions on behalf of its employees according to a bargaining agreement.
The plaintiffs seek contributions due, liquidated damages and interest, filing fees of $400 and service fees of $137.50, court costs and any further relief this court grants. They are represented by Charles W. Johnston of Charles W. Johnston, P.C. in Camp Hill.
