Erie Insurance Group accused of breaching contract

PITTSBURGH — Two insurance consumers are suing Erie Insurance Exchange, citing alleged breach of contract.

Sherry Wetzel and Joseph Battung filed a complaint on Sept. 7 in the Court of Common Pleas of Allegheny County, alleging that Erie Insurance failed to evaluate Wetzel's insurance claim in a fair manner.

According to the complaint, the plaintiffs allege that on Oct. 12, 2013, when both plaintiffs had underinsured motorist coverage from Erie, Wetzel was hit by an underinsured motorist while pushing a baby stroller. The plaintiffs claim Erie has improperly failed to pay the amount it should for Wetzel's claim and has handled the claim incorrectly.

The plaintiffs seek judgment against the defendant in an amount in excess of the jurisdictional arbitration limit of this court including interest, court costs and punitive damages. They are represented by Ciao, Torisky & O'Connor, LLC of Goodrich & Geist, P.C. in Pittsburgh.
