Trash collector alleges motorist negligently struck him

PITTSBURGH -- A Pittsburgh man is suing another city resident, alleging she struck him with a vehicle while he was working as a trash collector.

James E. Labishak Jr. filed a complaint on Sept. 15 in the Court of Common Pleas of Allegheny County against Janice Woester, alleging she was negligent in operating her vehicle.

According to the complaint, the plaintiff alleges that on April 14, he sustained serious physical injuries including traumatic brain injury and a facial fracture. The plaintiff holds Woester responsible because the defendant allegedly failed to keep a proper lookout while operating her vehicle.

The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount in excess of $35,000. He is represented by John A. Caputo of The Law Offices of John A. Caputo in Pittsburgh.
