Kennedy P.C., Robert A. Evarts accused of misrepresentation in debt collection

PHILADELPHIA — Representatives of a deceased person's estate are suing debt collectors, alleging misrepresentation in collection.

Allison Adamousky and Loriann Walters, as the executrixes of the estate of Johnnie Bataller, filed a complaint on Sept. 22 in the U.S. District Court for the Eastern District of Pennsylvania against Kennedy P.C. and Robert A. Evarts, alleging that they made false representations regarding the alleged debt.

According to the complaint, the plaintiffs allege that they sustained damages in the form of incurred legal fees. The plaintiffs hold the defendants responsible because they allegedly contacted the plaintiffs and presented false information regarding an alleged debt Bataller owed.

The plaintiffs seek statutory damages or actual damages not to exceed $150,000, treble damages, court costs and any further relief this court grants. They are represented by Alan B. Kane of The Law Office of Alan B. Kane in Norristown.
